이용약관

제1조 (목적)

본 약관은 홍남기획(HONGNAM Inc., 이하 "회사"라 한다)이 제공하는 워키파이(Walki-Fi) 서비스(이하 "서비스"라 한다)의 이용 조건 및 절차, 회사와 회원 간의 권리, 의무 및 책임사항을 규정함을 목적으로 합니다.

제2조 (용어의 정의)

이 약관에서 사용하는 용어의 정의는 다음과 같습니다.

  1. "서비스"라 함은 구현되는 단말기(PC, 휴대형 단말기 등)와 상관없이 이용자가 이용할 수 있는 워키파이(Walki-Fi) 관련 제반 서비스를 의미합니다.
  1. "이용자"라 함은 회사의 서비스에 접속하여 본 약관에 따라 회사가 제공하는 콘텐츠 및 제반 서비스를 이용하는 회원 및 비회원을 말합니다.
  1. "회원"이라 함은 회사의 서비스에 접속하여 본 약관에 동의하고, 계정을 생성하여 서비스를 이용하는 자를 말합니다.

제3조 (약관의 게시와 개정)

  1. 회사는 이 약관의 내용을 이용자가 쉽게 알 수 있도록 서비스 초기 화면 또는 연결 화면에 게시합니다.
  1. 회사는 관련 법령을 위배하지 않는 범위 내에서 본 약관을 개정할 수 있습니다.
  1. 회사가 약관을 개정할 경우에는 적용일자 및 개정사유를 명시하여 적용일자 7일 전부터 서비스 내에 공지합니다.

제4조 (서비스의 제공 및 변경)

  1. 회사는 다음과 같은 업무를 수행합니다.
    • 카카오·구글·애플 계정의 소셜 로그인 연동을 통한 회원 가입 및 계정 생성
    • 휴대폰 걸음 수 데이터 연동을 통한 가족 걷기 정보 제공 및 관리
    • 서비스 이용 기록 및 활동 데이터를 분석하여 맞춤형 광고, 제휴 챌린지 상품 추천 및 마케팅 알림(푸시 메시지) 발송
    • 가족 구성원 간의 활동량 및 목표 달성 현황 공유를 위한 가족 초대 및 연결 서비스
    • 기타 회사가 추가 개발하거나 다른 회사와 협력하여 회원에게 제공하는 일체의 서비스
  1. 회사는 서비스의 변경이 필요하고 상당한 이유가 있는 경우, 제공하고 있는 서비스의 전부 또는 일부를 변경할 수 있습니다.

제4조의2 (회원가입 및 연령 제한)

  1. 이용자는 카카오·구글·애플 계정을 이용한 소셜 로그인 방식으로 회원가입을 신청할 수 있으며, 가입 절차에서 본 약관 및 개인정보 처리방침에 동의하여야 합니다.
  1. 본 서비스는 만 14세 이상인 자만 이용할 수 있습니다. 이용자는 회원가입 시 '만 14세 이상입니다' 항목에 직접 동의(체크)하여야 하며, 해당 항목을 확인하지 않은 경우 회원가입 및 서비스 이용이 제한됩니다.
  1. 구글·애플 계정 연동 시 프로필 표시명 또는 프로필 사진이 제공되지 않거나 이용자가 그 제공에 동의하지 않은 경우, 회사는 기본 표시명 및 기본 프로필 이미지를 임의로 설정하며, 이용자는 가입 과정 또는 프로필 설정에서 이를 직접 변경할 수 있습니다.

제5조 (서비스 이용의 제한 및 중단)

  1. 회사는 컴퓨터 등 정보통신설비의 보수점검, 교체 및 고장, 통신두절 등의 사유가 발생한 경우 서비스의 제공을 일시적으로 중단할 수 있습니다.
  1. 이용자가 다음 각 호의 사유에 해당하는 경우 회사는 서비스 이용을 제한하거나 회원 자격을 상실시킬 수 있습니다.
    • 타인의 정보나 계정을 도용한 경우
    • 서비스의 운영을 고의로 방해한 경우
    • 범죄와 관련된 행위를 하는 경우

제6조 (유료 서비스 및 결제)

  1. 회사는 추후 특정 서비스나 기능을 유료로 제공할 수 있으며, 이 경우 유료 서비스 이용약관에 따릅니다.
  1. 유료 서비스 이용을 위한 결제는 회사가 지정한 결제 수단을 통해 이루어지며, 결제 정보의 오류로 인한 책임은 이용자에게 있습니다.
  1. 유료 서비스의 청약철회 및 환불은 관련 법령(전자상거래 등에서의 소비자보호에 관한 법률)에 따릅니다.

제7조 (개인정보보호)

회사는 이용자의 개인정보를 보호하기 위해 노력하며, 개인정보의 보호 및 사용에 대해서는 관련 법령 및 회사의 개인정보 처리방침이 적용됩니다.

제8조 (회사의 의무)

  1. 회사는 법령과 이 약관이 금지하거나 공서양속에 반하는 행위를 하지 않으며, 계속적이고 안정적으로 서비스를 제공하기 위해 노력합니다.
  1. 회사는 이용자의 개인정보 보호를 위한 보안 시스템을 구축합니다.

제9조 (이용자의 의무)

이용자는 서비스 이용 시 다음 행위를 하여서는 안 됩니다.

  1. 신청 또는 변경 시 허위 내용의 등록
  1. 타인의 정보 도용
  1. 회사가 게시한 정보의 변경
  1. 회사가 정한 정보 이외의 정보(컴퓨터 프로그램 등)의 송신 또는 게시
  1. 회사 및 기타 제3자의 저작권 등 지식재산권에 대한 침해
  1. 회사가 제공하는 걷기 데이터 연동 서비스를 이용하기 위해, 휴대폰 내 건강/피트니스 데이터 접근 권한을 정상적으로 허용하지 않는 행위
  1. 만 14세 미만인 자가 서비스에 가입·이용하거나, 연령 확인(만 14세 이상 여부) 정보를 허위로 표시하여 가입을 시도하는 행위

제10조 (면책조항)

  1. 회사는 천재지변, 불가항력 등 회사의 귀책사유가 아닌 사유로 서비스를 제공할 수 없는 경우에는 책임을 지지 않습니다.
  1. 회사는 이용자의 귀책사유로 인한 서비스 이용 장애에 대하여 책임을 지지 않습니다.

제11조 (분쟁의 해결 및 준거법)

  1. 회사와 이용자 간에 발생한 분쟁에 관하여는 대한민국 법을 준거법으로 합니다.
  1. 서비스 이용과 관련하여 회사와 이용자 사이에 발생한 분쟁에 관한 소송은 민사소송법상의 관할법원에 제기합니다.

Terms of Service

Article 1 (Purpose)

These Terms of Service set forth the conditions and procedures for using the Walki-Fi service (hereinafter the "Services") provided by HONGNAM Inc. (hereinafter the "Company"), as well as the rights, obligations, and responsibilities between the Company and its Members.

Article 2 (Definitions)

The definitions of the terms used in these Terms of Service are as follows.

  1. "Services" means all Walki-Fi-related services that a User may use, regardless of the device on which they are implemented (PC, mobile device, etc.).
  1. "User" means a Member or non-member who accesses the Company's Services and uses the content and services provided by the Company in accordance with these Terms of Service.
  1. "Member" means a person who accesses the Company's Services, agrees to these Terms of Service, creates an account, and uses the Services.

Article 3 (Posting and Amendment of the Terms)

  1. The Company shall post the contents of these Terms of Service on the initial service screen or a linked screen so that Users can easily access them.
  1. The Company may amend these Terms of Service to the extent that such amendment does not violate applicable laws.
  1. When the Company amends these Terms of Service, it shall announce the amendment within the Services, specifying the effective date and the reason for the amendment, from at least seven (7) days prior to the effective date.

Article 4 (Provision and Modification of Services)

  1. The Company performs the following functions.
    • Member registration and account creation through social login integration with Kakao, Google, and Apple accounts
    • Provision and management of family walking information through integration of mobile step-count data
    • Analysis of service usage records and activity data to deliver personalized advertising, recommendations for affiliated challenge products, and marketing notifications (push messages)
    • Family invitation and connection services for sharing activity levels and goal achievement status among family members
    • Any other services that the Company develops additionally or provides to Members in cooperation with other companies
  1. Where there is a reasonable ground requiring a change to the Services, the Company may modify all or part of the Services it provides.

Article 4-2 (Membership Registration and Age Restriction)

  1. A User may apply for membership registration via social login using a Kakao, Google, or Apple account, and must agree to these Terms of Service and the Privacy Policy during the registration process.
  1. The Services may be used only by persons 14 years of age or older. Upon registration, a User must affirmatively agree to (check) the item "I am 14 years of age or older." If the User does not confirm this item, membership registration and use of the Services are restricted.
  1. Where a profile display name or profile photo is not provided through Google or Apple account integration, or where the User does not consent to the provision of such information, the Company shall set a default display name and default profile image, and the User may change them directly during the registration process or in the profile settings.

Article 5 (Restriction and Suspension of Service Use)

  1. The Company may temporarily suspend the provision of the Services in the event of maintenance, inspection, replacement, or failure of information and communications equipment such as computers, or in the event of disruption of communications.
  1. Where a User falls under any of the following, the Company may restrict the User's use of the Services or revoke the User's membership.
    • Where the User has stolen another person's information or account
    • Where the User has intentionally interfered with the operation of the Services
    • Where the User engages in crime-related conduct

Article 6 (Paid Services and Payment)

  1. The Company may provide certain services or features for a fee in the future, in which case the terms of service for paid services shall apply.
  1. Payment for the use of paid services shall be made through a payment method designated by the Company, and the User shall be responsible for any errors in payment information.
  1. Withdrawal of subscription and refunds for paid services shall be governed by applicable laws (the Act on the Consumer Protection in Electronic Commerce, etc.).

Article 7 (Protection of Personal Information)

The Company endeavors to protect Users' personal information, and the protection and use of personal information shall be governed by applicable laws and the Company's Privacy Policy.

Article 8 (Obligations of the Company)

  1. The Company shall not engage in any act prohibited by applicable laws or these Terms of Service or contrary to public order and good morals, and shall endeavor to provide the Services continuously and reliably.
  1. The Company shall establish a security system to protect Users' personal information.

Article 9 (Obligations of Users)

Users shall not engage in any of the following acts when using the Services.

  1. Registering false information at the time of application or modification
  1. Misappropriating another person's information
  1. Altering information posted by the Company
  1. Transmitting or posting information other than that designated by the Company (such as computer programs)
  1. Infringing the intellectual property rights, including copyrights, of the Company or any third party
  1. Failing to properly grant access permissions to health/fitness data on the mobile device that are necessary to use the walking-data integration services provided by the Company
  1. Registering for or using the Services as a person under 14 years of age, or attempting to register by falsely indicating the age verification ("14 years of age or older") information

Article 10 (Disclaimer)

  1. The Company shall not be liable where it is unable to provide the Services due to causes not attributable to the Company, such as natural disasters or force majeure.
  1. The Company shall not be liable for any disruption to service use caused by reasons attributable to the User.

Article 11 (Dispute Resolution and Governing Law)

  1. The laws of the Republic of Korea shall govern any dispute arising between the Company and a User.
  1. Any lawsuit concerning a dispute arising between the Company and a User in connection with the use of the Services shall be filed with the competent court under the Civil Procedure Act.
